Processing of personal data and instruction of the data subject

Conditions for the protection of personal data
I. Main/basic regulation
The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “EU GDPR”) is LUMINEX, spol. s r.o. (hereinafter referred to as the “Administrator”).

Personal data is any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
The administrator has not appointed a data protection officer.
II. Processed sources and categories of personal data
The administrator processes personal data that you have provided to them or personal data that the administrator has obtained as a result of fulfilling your order.
The administrator processes your identification and contact details, as well as the data necessary for the fulfillment of the contract.
III. Legal basis and purpose of processing personal data
The legal basis for the processing of personal data is
| • | Contract performance between you and the administrator pursuant to Article 6(1)(b) of the EU GDPR, |
| • | the legitimate interest of the administrator in providing direct marketing (in particular for sending commercial communications and newsletters) in accordance with Article 6(1)(a)(f) of the EU GDPR, |
| • | Your consent to processing for the purpose of providing direct marketing (in particular for sending advertising messages and newsletters) in accordance with Article 6(1)(a) of the EU GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll. on certain information society services, in the event that no goods or services have been ordered. |
The purpose of processing personal data is
| • | The execution of your order and the exercise of rights and obligations arising from the contractual relationship between you and the administrator; When placing an order, personal data is required that is necessary for the successful execution of the order (name and address, contact details). The provision of personal data is a necessary prerequisite for the conclusion and fulfillment of the contract. Without providing personal data, it is not possible to conclude or execute the contract. |
| • | Sending business messages and performing other marketing activities. |
The administrator has an automatic individual decision within the meaning of Article 22 of the EU GDPR. You have expressly consented to such processing.
IV. Data retention period
The administrator stores personal data
| • | for the time necessary to exercise the rights and obligations arising from the contractual relationship between you and the administrator and to assert claims arising from these contractual relationships (for a period of 10 years from the termination of the contractual relationship). |
| • | until consent to the processing of personal data for marketing purposes is revoked for a maximum of 3 years, if the processing is based on consent. |
After the retention period for personal data has expired, the administrator will delete the personal data.
V. Recipients of personal data (subcontractors responsible for processing)
The recipients of personal data are persons
involved in the delivery of goods/services/execution of payments on the basis of a contract,
provision of e-shop operating services and other services related to e-shop operation,
the provision of marketing services,
for the purpose of accounting for tax documents in accordance with the contract and generally binding legal provisions to the following extent:

| • | Data on administrator performance. |
The controller does not intend to transfer personal data to a third country (a non-EU country) or an international organization.
VI. Your rights
Under the conditions set out in the EU GDPR, you have
| • | the right to access your personal data in accordance with Article 15 of the EU GDPR, |
| • | the right to rectification of personal data pursuant to Article 16 of the EU GDPR or restrictions on processing pursuant to Article 18 of the EU GDPR. |
| • | the right to erase personal data in accordance with Article 17 of the EU GDPR. |
| • | the right to object to processing pursuant to Article 21 of the EU GDPR |
| • | the right to data portability pursuant to Article 20 of the EU GDPR. |
| • | the right to withdraw consent to processing in writing or electronically to the address or email address of the administrator specified in Article III of these Terms and Conditions. |
You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.
VII. Conditions for the security of personal data
The data controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
The administrator has taken technical measures to secure data repositories (login name, password, antivirus program, and firewall) and repositories for personal data in paper form (locked room).
The controller declares that only persons authorized by him have access to personal data.
VIII. Final provisions
By submitting an order via the online order form, you confirm that you are familiar with the terms and conditions of personal data protection and accept them in full.

The administrator has the right to change these terms. The new version of the personal data protection policy will be published on their website. At the same time, the new version of this policy will be sent to you via the email address you provided to the administrator.
These terms come into force on May 25, 2018.
